How to Submit a Takedown Notice
If you believe that content available on our Website infringes your copyright, you may submit a written notification (a “DMCA Takedown Notice”) to our designated DMCA Agent. The notice must include the following:
- Identification of the copyrighted work that you believe has been infringed.
- Identification of the infringing content, including the URL or other specific location details, and which portion of the content infringes your rights.
- Your contact information, including name, mailing address, telephone number, and email address.
- A statement that you have a good faith belief that the use of the content infringes your copyright and is not authorized.
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner.
- Your physical or electronic signature.
If you submit a DMCA Takedown Notice that does not sufficiently identify the content that you believe infringes your work, or that fails to provide the necessary information required under the DMCA, we may not be able to act on your request. In such cases, we will notify you and request additional details. If you do not provide the necessary clarifications, we may not be able to take action.
Submit your DMCA Takedown Notice to the Kate's App DMCA agent identified in this policy.
Upon receipt of a valid DMCA notice, we will disable access to the content identified in your claim and notify the user responsible for that content.
How to Submit a Counter-Notification
If you receive a notice that your content was removed due to a DMCA takedown notice, and you believe that the claim of infringement was mistaken, you may submit a written counter-notification that includes:
- Identification of the content that was removed and the location where it previously appeared.
- A statement, under penalty of perjury, that you have a good faith belief that the content which was removed did not violate any copyrights.
- Your contact information, including name, address, telephone number, and email.
- A statement consenting to the jurisdiction of the federal court in your district and agreeing to accept service of process from the copyright owner.
- Your physical or electronic signature.
Send your counter-notification to the Kate's App DMCA agent identified in this policy.
If we receive a valid Counter-Notification, we may restore the removed content in 14 days unless the original complainant files a court action.
Repeat Infringer Policy
Kate's App reserves the right to terminate, suspend, or restrict access to any user who is determined to be a repeat infringer of copyrighted material.
We may take further action, including removing content, restricting access, disabling accounts, or banning users, at our sole discretion, without prior notice.
If you believe your content was removed in error, you may file a counter-notification as per our DMCA procedures. However, repeated violations may still result in account termination, regardless of counter-notifications.
Neutrality Policy
Kate's App is a neutral service and does not take sides in copyright disputes. Our role is strictly administrative. We comply with the Digital Millennium Copyright Act (DMCA) by processing takedown notices and counter-notifications as required by law.
- We do not independently verify the accuracy of allegations or defenses.
- We do not provide legal advice, mediation, or assistance to either party in a dispute.
- We are not responsible for adjudicating copyright ownership or infringement claims.
Any legal disputes between the copyright owner and the user who posted the allegedly infringing content must be resolved in court, not by our service.
